The Planning and Development (Amendment) Act 2021 will provide for reform of judicial review provisions outlined in the Planning and Development Acts 2000-2021.

 

The Act will amend and extend the Planning and Development Acts 2000 to 2021 in relation to applications for planning permission for certain large-scale residential development and will look to amend Part V of the Planning and Development Act 2000 so that the need for housing for owner-occupiers can be taken into account in housing strategies as well as focus on Covid-19 relief.

 

The Act will also amend the current provisions in response to disruption caused by restrictions introduced in response to the Covid-19 pandemic. It will provide for an additional period for the preparation of development plans required by planning authorities, so they may extend the duration of existing development plans pending the preparation and making of new development plans and subject to the requirement to carry out certain environmental assessments.

 

It will also provide for the notification of proposals to extend the duration of existing development plans to the Office of the Planning Regulator and for the further extension of the duration of the appropriate period of certain planning permissions.

 

Our update seminar will provide an introduction to planning and judicial review and outline what the new amendments will mean for those involved in planning and environmental assessments.

 

It will also provide a focus on judicial review using relevant case law and outline any additional upcoming changes that relevant organisations should be aware of.
