Seminar Overview

The AIE Regulations allow access to environmental information held by a public authority. These Regulations also outline the manner in which requests for information may be submitted to public authorities, as well as the manner in which public authorities are required to deal with requests.

The AIE Regulations also provide for a formal appeals procedure known as an internal review in the event that a person is unhappy with the decision about their request. If an applicant is still unhappy after an internal review they may apply to the Office of the Commissioner for Environmental Information (OCEI) or an independent decision on the matter.

The number of access requests under the AIE Regulations are increasing steadily, as noted in the Annual Reports of the Commissioner for Environmental Information. Environmental issues are now reported upon more frequently in the media. Furthermore, climate litigation against governments, corporations and fossil fuel companies continues to increase across the world.

This one-day online training course will focus on the requirements for processing a request. It will examine the application of certain exemptions, the appeals process, procedural issues, key OCEI decisions and more.

Participants will leave the course with a much more advanced understanding of the AIE Regulations.

What is Environmental Information?

The AIE Regulations define environmental information as:

“any information in written, visual, aural, electronic or any other material form on the below

– environmental elements (soil, land, water, air etc)

– factors affecting the elements of the environment (waste, discharges, emissions)

– human health and safety

What Public Bodies are Subject to AIE?

According to the official government website,

The AIE Regulations broadly define “public authorities” to encompass all bodies that have a role in public administration and that possess environmental information. It is important to note that this definition is broader in scope than the definition of “public body” in the FoI Acts.

Under the 2011 Regulations, the Minister is required to publish an indicative list of public authorities that are subject to the AIE Regulations. These are:

  • government departments
  • local authorities
  • non-commercial state agencies
  • commercial state agencies
  • regulatory bodies
